Terms of Service
The rules for accounts, marketplace use, and your relationship with Framivio.
1. Who operates the service
Framivio is a photo and video marketplace operated under the business name Framivio Productions. Contact framiviosupport@gmail.com for support, privacy requests, or copyright reports. Eligible listings and subscriptions support paid checkout through Stripe. These policies remain drafts requiring professional review; the legal entity details, business mailing address, and jurisdiction-specific provisions remain to be finalized.
2. Agreement and account responsibility
Creating an account through this website requires an affirmative agreement to these Terms and acknowledgment of the Privacy Policy. You must provide accurate account details, protect your login, and use only accounts you are authorized to control. You must have legal capacity to enter the applicable agreement; where a person lacks that capacity, a legally responsible parent or guardian must manage the account and review the terms. This service is not intended for independent use by children. Age eligibility and any required parental-consent process must be finalized with qualified counsel.
3. Marketplace roles
Creators are responsible for their uploads, descriptions, permissions, and delivery commitments. Buyers must verify that the stated license fits their intended use. Framivio facilitates discovery and authorized access; it does not guarantee that a seller owns every claimed right or that a file is suitable for every project. Approval of a listing is not legal clearance. Do not rely on sample pricing, earnings displays, or unavailable features as a commercial promise.
4. Your content and service permission
You retain the rights you hold in your original content. Uploading grants Framivio a limited, nonexclusive permission to store, process, generate previews, and display or deliver that content only as needed to operate the features you choose. Public listings may have public previews. Private family collections are not licensed for public marketing merely because you upload them. This permission does not transfer copyright ownership to Framivio.
5. Purchases, requests and licenses
A buyer receives only the license expressly described in the completed order, not ownership of the underlying copyright. No purchase license is issued by viewing a preview or saving a cart. Charges, currency, applicable taxes, platform fees, and creator proceeds must be disclosed before paid checkout. Buyer requests and proposals do not create escrow or guarantee payment. Eligible approved deliveries can be purchased through checkout. Do not treat a proposal as money held by Framivio.
6. Prohibited conduct
Do not upload stolen, illegal, exploitative, threatening, hateful, fraudulent, or nonconsensual intimate content. Do not impersonate staff or creators, circumvent access controls, scrape private media, distribute malware, or attempt to steal credentials. Do not publicly list identifiable images or videos of children in this initial version. The Community Guidelines and Seller Requirements explain these restrictions further.
7. Private collections and third parties
Only share material you are authorized to share, and invite only intended recipients. A family relationship is not automatic permission to distribute another person’s sensitive information. Authorized recipients may retain downloaded copies; removing access cannot retrieve copies already saved. Private storage is access-controlled, not a promise of end-to-end encryption or absolute confidentiality. Keep an independent backup of irreplaceable originals.
8. Enforcement, termination and disputes
Access or content may be restricted to investigate suspected abuse, infringement, safety risks, or legal requirements. Where appropriate and lawful, affected users should receive a reason and an opportunity to challenge a decision. Mandatory consumer and privacy rights are not waived by these draft terms. No arbitration clause, class-action waiver, or selected governing law is imposed in this draft. Send disputes to framiviosupport@gmail.com. Jurisdiction-specific procedures remain subject to professional review.
9. Availability, responsibility and changes
The service may contain errors, change, or become unavailable. It is not a guaranteed archive or a substitute for independent rights clearance. No term excludes liability or remedies that applicable law does not permit to be excluded. Final warranty, liability, cancellation, and retention terms require legal review. Material future changes must be clearly presented, with renewed agreement where required. Acceptance is recorded against a specific document version; it is not backdated for existing accounts.
